By accessing or using the site you agree to these terms. If you do not agree, please do not use the site. If you use the site on behalf of a company or other organisation, you confirm that you are authorised to accept these terms on its behalf.

3. Information Only, Not an Offer
The content of this site describes our services and how we usually work. It is provided for general information only. It is not an offer, a quote, or professional, legal or technical advice, and you should not rely on it as such.
Nothing on this site, and no email exchanged through it, creates a contract or obliges us to provide any service. Any work we carry out is governed exclusively by the written quote and agreement we make with you for that project. If anything in those documents differs from this site, those documents apply.
Examples, descriptions and indications of timelines or results are illustrative. Outcomes such as loading speed or search rankings depend on many factors outside our control, and we make no promise about them on this site.

The site and everything on it, including its text, design, layout, illustrations, animations, code, logos and the xoco name, are owned by XOCO WEB SRL or used under licence, and are protected by copyright, trademark and other intellectual property laws.
You may view the site, share links to it, and quote short passages with attribution. You may not otherwise copy, reproduce, modify, distribute, republish, frame or commercially exploit any part of the site, or use our name or branding, without our prior written consent.
5. Acceptable Use
You agree to use the site lawfully and not to:
- attempt to gain unauthorised access to the site, its servers or any connected system;
- interfere with, disrupt or overload the site, including through denial-of-service attacks, or introduce viruses or other harmful code;
- use automated tools to scrape, copy or index the site in a way that harms its availability or breaches these terms;
- use the site to send us unlawful, defamatory, infringing, harassing or unsolicited content, or to impersonate anyone else;
- use the site in any way that breaches applicable law or the rights of others.
We may restrict or block access to the site for anyone who breaches these terms.

We aim to keep the site available and secure, but we do not guarantee that it will always be available, uninterrupted, error-free, or free of viruses or other harmful components. We may change, suspend or withdraw any part of the site at any time without notice. You are responsible for protecting your own devices and data, including with up-to-date security software.
7. External Links
The site links to websites run by others, such as GitHub and our template shop. We have no control over those sites and are not responsible for their content, availability, security or privacy practices. A link does not mean we endorse the site it points to. Your use of any external site is at your own risk and subject to its own terms.
8. Disclaimer
The site and its content are provided "as is" and "as available". To the fullest extent permitted by law, we exclude all warranties, representations and conditions, express or implied, including any about the accuracy, completeness, timeliness, reliability, suitability for a particular purpose or non-infringement of the site or its content.
9. Limitation of Liability
To the fullest extent permitted by law, XOCO WEB SRL, its directors, employees and contractors are not liable for any loss or damage of any kind arising out of or in connection with the site, including your use of it, your inability to use it, your reliance on its content, or any virus or harmful code, whether in contract, tort (including negligence), breach of statutory duty or otherwise. This includes, without limitation, loss of profits, revenue, business, opportunity, goodwill or data, and any indirect, special or consequential loss, even if we were told such loss was possible.
Where our liability cannot be excluded but can be limited, our total liability arising from the site is limited to one hundred euros (EUR 100).
Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for intentional misconduct or gross negligence where Romanian law does not allow it to be limited. Nothing in these terms affects the statutory rights you have as a consumer.
10. Indemnity
If you are using the site for business purposes, you agree to indemnify XOCO WEB SRL against any claims, losses, costs and expenses, including reasonable legal fees, arising from your breach of these terms or your misuse of the site.
11. Governing Law and Disputes
These terms, and any dispute arising from them or from the site, are governed by Romanian law. The competent courts of Romania have jurisdiction, except that if you are a consumer resident in another EU or EEA country, you keep the protection of the mandatory laws of that country and may bring proceedings there.

Consumers may also contact the Romanian National Authority for Consumer Protection (ANPC) at anpc.ro (opens in a new tab), use a competent alternative dispute resolution entity, or, for a cross-border complaint within the EU, seek advice from the European Consumer Centres Network (ECC-Net).
12. General
Severability. If any provision of these terms is found invalid or unenforceable, it is limited or removed to the minimum extent necessary, and the rest of the terms remain in full force.
No waiver. If we do not enforce a provision straight away, we can still enforce it later.
Assignment. We may transfer our rights and obligations under these terms, for example as part of a reorganisation or sale of our business. You may not transfer yours without our written consent.
Force majeure. We are not responsible for any failure or delay caused by events outside our reasonable control, including outages at our hosting or network providers, cyberattacks, or acts of public authorities.
Entire agreement. These terms, together with the Privacy Policy and Cookie Policy, are the entire agreement between you and us about your use of the site.
Language. These terms are written in English. If they are translated, the English version prevails to the extent permitted by law.
13. Changes to These Terms
We may update these terms at any time by publishing a new version on this page with a new date. Changes apply from the date of publication. Your continued use of the site after that date means you accept the updated terms.
